CONTEST RULES
Tread Lightly Sweepstakes Contest
No purchase necessary. Void where prohibited. This “Tread Lightly Sweepstakes Contest” (the “Contest”) is sponsored by Raincoast Books (the “Sponsor”).
The Sponsor is the exclusive sponsor and administrator of the Contest. By submitting an entry for the Contest, each entrant unconditionally agrees to be bound by
the Rules and the decisions of the Sponsor, which shall be final and binding in all respects. Failure to comply with the Rules will result in an automatic disqualification of the
entrant from the Contest.
WHO CAN WIN
This Contest is open to all residents of Canada (the “Eligibility Area”) who are 18 years of age or older at the time of entry. Employees and agents of the Sponsor,
their respective parent companies, affiliates, subsidiaries, advertising and promotional agencies, assignees, licensees and members of their immediate families (spouse and children,
siblings and parents and their spouses) and individuals residing in the domiciles of each of the above are ineligible. All entries must be received by the Contest Closing Date (as defined below).
HOW TO ENTER
Internet access is required to enter. The Contest begins on Wednesday, April 15, 2009 at 9:00 a.m. (Pacific) (the “Contest Start Date”) and ends on Sunday, August 30, 2009 at
5:00 p.m. (Pacific) (the “Contest Closing Date”) (the “Promotion Period”). Entries for the Contest will only be accepted via an online sweepstakes entry form at
http://www.raincoast.com/lonelyplanet. To enter, eligible entrants must fill out all required fields denoted on the entry form, and click on “submit”, at any time during the
Promotion Period. Limit one (1) entry per day, per person. Entries must be made by participants resident within the Eligibility Area and received by the Sponsor within the Promotion
Period. Entries that do not comply with the Rules in all respects are ineligible and void.
CONDITIONS OF ENTRY
The entrant must be the Registered and Authorized Holder of the E-mail Account through which the entry is made. For purposes of the Contest, a
“Registered and Authorized Holder of the E-mail Account” is defined as the natural person who is assigned to an e-mail address by an internet service provider, online
service provider or other entity (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the secondary level domain name associated
with the submitted e-mail address. All entries must be made by an individual from a single computer and may not be made by proxy, or electronic means such as script, bot,
macro or any other similar software or program. All entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged,
falsified, altered or tampered with in any way.
SELECTION PROCESS
The potential winner will be selected by a random draw from among all eligible entries received via the internet by the Contest Closing Date. The draw will take place on September 1,
2009 at 9:00 a.m. (Pacific) in Vancouver, British Columbia. Odds of winning will depend on the total number of eligible entries received during the Promotion Period. The selected
entrant will be notified by telephone and/or email. In the event that the Sponsor is unable to notify the selected entrant within five (5) days of selection, the selected entrant will be
disqualified and an alternate potential winner will be selected from all remaining eligible entries. Prior to being declared a winner, the selected entrant must first: (a) correctly answer,
unaided, a time-limited, skill-testing question posed by telephone or email; (b) complete a written declaration confirming compliance with the Rules and acceptance of the grand prize as
awarded; (c) sign and return within five (5) days of receipt, any and all waivers or releases and any other documentation that may be required by the Sponsor.
In turn, the grand prize winner will be required to complete a UTracks’ booking form, which states they understand and agree to UTracks’ terms and conditions. Upon signing the
booking form, the grand prize winner will be bound to these terms and conditions excluding conditions referring to payment (detailed below under “Prize’).
PRIZE
One (1) grand prize of an eight (8) day trip for two (2) to Genal Valley in southern Spain will be awarded. The grand prize includes: (a) return economy airfare for two (2) persons
(two (2) adult airfares) from the Canada to Malaga, Spain; travel covered by the prize will commence at the international airport closest to the winner’s Canadian residence
from which the participating airline flies to Malaga (b) seven (7) nights accommodation (double occupancy) and select during the self guided tour of the Genal Valley tour as organized
by UTracks (c) transfer to and from Malaga airport.
The approximate retail value of the grand prize is $5,000.00 (Cdn) based on a departure from Toronto, Ontario. All other expenses, including insurance, taxes and gratuities,
and proper travel documentation remain the sole responsibility of the winner. A valid credit card (or cash deposit, as set out by the hotel) will be required at hotel check-in.
The grand prize will be awarded to the selected entrant, who must be over the age of eighteen (18). The guest of the grand prize winner must also be over the age eighteen (18).
For security reasons the grand prize winner and guest must travel together on the eight day unescorted trip through the Genal Valley. Both grand prize winner and guest must self-complete
a medical form. If either grand prize winner or guest are age seventy (70) or older or have a pre-existing medical condition, their doctor must sign the medical form.
The grand prize will be delivered to the address indicated on the entry form. The grand prize must be accepted as awarded, is non-transferable or convertible into cash and may not be sold,
traded or transferred, except that the Sponsor reserves the right in its absolute discretion to substitute a prize of equivalent kind and value without prior notification in the event of the
unavailability of any element of the grand prize for any reason whatsoever.
Certain travel restrictions apply. Subject to availability and the discretion of the Sponsor, and the winner will depart for travel between May and November 2010.
The potential winner and his or her guest must depart from the same city. If for any reason the winner and his or her guest are unable to travel in the time frames stated or
should the potential winner refuse the grand prize, the grand prize will be forfeited and an alternate potential winner will be selected. No compensation or alternative will be provided
and the Sponsor and its respective advertising and promotional agencies are released from any obligations whatsoever related to the grand prize.
PRIVACY
By entering the Contest and voluntarily providing personal information, including, but not limited to the entrant’s name, address, age, e-mail address (collectively, the
“Entrant Information”), the entrant consents and agree to the Sponsor’s collection and use of the Entrant Information to administer the Contest. The consent of the entrant
to the Sponsor’s use of Entrant Information may be revoked at any time (which will also revoke the entrant’s participation in the Contest or impair the chances of winning) by
writing to: Raincoast Books, 9050 Shaughnessy Street, Vancouver, British Columbia, Canada, V6P 6E5. All entries become the property of the Sponsor and will not be acknowledged or
returned. No correspondence will be entered into except with the selected entrant and individuals requesting a copy of the Rules. A copy of the Rules may be received by sending a self-addressed
stamped envelope to Raincoast Books, 9050 Shaughnessy Street, Vancouver, British Columbia, Canada, V6P 6E5, before August 30, 2009.
LIMITATION OF LIABILITY
The Sponsor and its affiliates, its advertising and promotional agencies, retailers, distributors and suppliers, and each of their respective directors, officers, employees, agents,
representatives and shareholders and all others associated with the development and execution of the Contest (collectively, the “Released Parties”) shall have no liability and shall be
held harmless in respect of any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever,
including, but not limited to, claims based on negligence, breach of contract and liability for any physical injury, death or property damage which the entrant and their respect administrators,
heirs, successors or assigns may have by reason or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or use or misuse of the grand prize
or any element thereof. The Released Parties accept no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the websites during the Promotional Period,
for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail or entry
to be received by the Sponsor on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s
or any other person’s computer related to or resulting from accessing, playing or downloading any material in connection with the Contest. The Sponsor reserves the right, in its sole discretion to
cancel or suspend this Contest should a virus, bug or other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Contest.
LEGAL
This Contest is subject to all applicable federal, provincial and municipal laws. Any attempt to deliberately damage any website or to undermine the legitimate operation of this
promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by
law, including criminal prosecution.
The Sponsor retains the right, in its sole discretion, to terminate, amend or alter the rules of the Contest at any time without notice for any reason whatsoever.
For residents of Quebec only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.
Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
